How will EPA move forward on revisiting Calif. waiver?
Now that President Obama has directed regulators to revisit California's request for a waiver to set higher tailpipe emissions standards, what's next?
A statement from Environmental Protection Agency Administrator Lisa Jackson wasn't too revealing on the process for revisiting and approving the waiver: "Knowing EPA has the full support of the President as we proceed to revisit the Bush era denial of the California waiver is very encouraging. The President's actions today herald a sea change in America's commitment to addressing climate change."
Jackson had already promised as much in her confirmation hearing, so this isn't terribly enlightening. Attempts to get more, er, details out of an EPA spokesperson were unsuccessful. Luckily, the agency has put together this handy guide to waivers. One tidbit:
The Clean Air Act gives California special authority to enact stricter air-pollution standards for motor vehicles than the federal government's. EPA must approve a waiver, however, before California's rules may go into effect. Once California files a waiver request, EPA publishes a notice for public hearing and written comment in the Federal Register. The written comment period typically remains open for a period of time after the public hearing. Once the comment period expires, EPA reviews the comments and the administrator determines whether California has satisfied the law's requirements for obtaining a waiver.
Under the Clean Air Act's Section 209, the EPA is supposed to grant a waiver unless it finds that California "was arbitrary and capricious in its finding that its standards are in the aggregate at least as protective of public health and welfare as applicable federal standards." Other reasons for rejecting a waiver are if the state "does not need such standards to meet compelling and extraordinary conditions," or if the state's policy conflicts with other sections of the act.
Because the Bush administration's EPA already went through the entire process of reviewing the information on this waiver, it's unlikely that Obama's team will have to go through that again; the science and the law haven't changed (despite the Bush administration's best efforts). According to David Doniger, the policy director at the Natural Resources Defense Council's climate center, the most likely scenario is that Jackson and her staff review the previous records and come to their own determination about whether to grant the waiver.

Adopting tougher emissions standards, new eco-label in Washington
California gets all the glory. As Kate mentioned, President Obama has ordered the EPA to reconsider a request from California and 13 other states to set automobile emissions standards that are tougher than federal standards. It's that "13 other states" phrase that should be most important to Puget Sound readers, as Washington is one of the bunch.
Along with Arizona, Connecticut, Maine, Maryland, Massachusetts, New Jersey, New Mexico, New York, Oregon, Pennsylvania, Rhode Island, and Vermont, Washington has pledged to adopt California's standards, which would aim to reduce vehicle greenhouse-gas emissions 30 percent by 2016.
So what has to happen here once the California waiver is OK'd? Well, technically, nothing. Once those stricter standards are approved for California, they'll go into effect here in Washington, starting with the 2011 model year vehicles (which you'll start to see on dealer lots next year). That is, unless state courts get involved. According to Sandy Howard of Washington's Department of Ecology, there are still some pending state lawsuits that could affect the overall outcome.
Well, if we can't force automakers to build greener cars, how about shaming consumers into buying greener cars?

Will state emission standards kill the U.S. car industry?
Sunday night The New York Times published, "Obama to Let States Restrict Emissions Standards." First reaction of those concerned only with a so-called economic recovery: "this will kill what's left of the U.S. car industry!"
Wrong! This is exactly what the domestic car industry needs. No "car czar" or other federal regulator would be able to push as hard to get more fuel-efficient and lower-emissions vehicles produced in the U.S. faster than regulation-constrained market demand.
That $17 billion provided as emergency support to GM and Chrysler had no real strings on fuel efficiency and emissions attached. Anyone who thinks the U.S. manufacturers could continue to compete with European and Asian car makers whose products are more energy efficient and less polluting -- and who are ahead of the domestic producers in their command of the new technologies -- is dreaming.
We needed something to shake them up fast. This action by the Obama administration will do just that, without having to spend any of the new White House political capital on working new regulations through Congress.

Toyota becomes world's biggest automaker, Prius goes solar, and other green auto news
Toyota this week officially overtook the ailing General Motors to become the world's largest automaker. Both companies saw sales declines in 2008, but Toyota's 8.97 million vehicles sold bested its U.S. rival by about 620,000. GM was the globe's undisputed auto-king for 77 years.

Meanwhile, Toyota announced Tuesday that it would launch a Certified Used Hybrid program.

• Fiat agreed to take a 35 percent stake in Chrysler, which prompted speculation from media types that small, full-efficient, Italian-leathered, pentastar-bedecked coupes would be heading our way soon.

Some commenters suggested my earlier post, "Chrysler to electrify entire product line," should have been filed under "humor." How was the company going to survive the current collapse of the auto industry, let alone find the money to invest in green cars?
But now the NYT reports:
The Italian automaker Fiat agreed on Tuesday to take a 35 percent stake in the struggling American auto company Chrysler, which was forced last month to seek a federal bailout amid fears it might not survive.
And, as the article notes, this creates a real eco-opportunity for Chrysler:

Photos from Plug In America's inaugural parade
Saturday morning, EV RIDRs and Obamamaniacs converged on the Santa Monica Civic Center to advocate for electric vehicles and celebrate President-elect Barack Obama's inauguration. The Inaugural (EV) Parade West, led by Plug in America, attracted over 70 electric and hybrid vehicles to zoom the city streets in PEBO's honor. Four Tesla Roadsters, 40 Toyota RAV-4 EVs, one converted Porsche Speedster, and even one converted EV Hummer H2 (!?) joined the festivities.
(To the New York Times editorial board: I believe these are the folks who will drive Detroit's fuel-efficient and electric vehicles. That is, once they are actually available.)

Automakers parade EVs in Detroit, Ontario Betters itself, and more green auto news
• Detroit: It's still around, and as long as the feds continue to give transit short-shrift, we'll be driving and bailing for years to come. But in honor of our societal shift toward fuel efficiency, the automakers have some brand new electric vehicles and hybrids they have been showing off this week at the North American International Auto Show, Jan. 11-25.
From the third-generation Prius to the Dodge Circuit to the Mini E, talk of fuel efficiency and battery-life replaced praise for horsepower and chrome. Thank goodness for the 505-horsepower Revenge GTM-R or we might confuse ourselves and our cars with those subdued European models.
While electric vehicles stole the auto show, Toyota's executive vice president, Masatami Takimoto, said in an interview with the New York Times that Toyota would produce a hydrogen fuel-cell vehicle by 2015. GM's lead engineer on the Volt also thinks Hydrogen is the fuel of the future -- I guess he hasn't read Joseph Romm's opinions on the matter. GM's Larry Burns, vice president of research and development and strategic planning, thinks Toyota has a lock on hybrids and that the Americans need to "change the game," but he didn't specify if that meant a focus on hydrogen.

Who's killing the plug-in hybrid?
This East Bay Express story is a must-read article. The same folks who decided the hydrogen highway was the road to the future now very well might kill the plug-in hybrid conversion industry.
I'd say we should send them a copy of Who Killed the Electric Car?, but chances are they only have Betamax.
